Özet
Özel istihdam büroları aracılığıyla geçici iş ilişkisi kurulması ilk defa 06.05.2016 tarihli ve 6715 sayılı “İş Kanunu ile Türkiye İş Kurumu Ka-nununda Değişiklik Yapılmasına Dair Kanun”-la hukuka uygun bulunmuştur. Türkiye Büyük Millet Meclisi tarafından kabul edilen Kanun, 20.05.2016 tarihli 29717 sayılı Resmi Gazete’de yayımlanarak yürürlüğe girmiştir. Bu Kanun ile 4857 sayılı İş Kanunu’nun “geçici iş ilişkisi” ke-nar başlıklı 7. maddesine özel istihdam bürola-rı hakkında ayrıntılı düzenlemeler eklenmiştir. Ayrıca 11 Ekim 2016 tarihinde bu konuya iliş-kin olarak “Özel İstihdam Büroları Yönetmeli-ği” çıkarılmıştır. İş Kanunu’nun 7. maddesinin mevcut durumu dikkate alındığında, özel istih-dam bürosu aracılığıyla ya da holding bünyesi içinde veya aynı şirketler topluluğuna bağlı başka bir işyerinde görevlendirme yapılmak suretiyle geçici iş ilişkisi kurulabilecektir. Özel istihdam bürosu aracılığıyla kurulan geçici iş ilişkisi, meslek edinilmiş geçici iş ilişkisi olarak da nitelendirilmektedir. Biz bu çalışmamızda, özel istihdam bürosu aracılığı ile kurulan geçi-ci iş ilişkisine dair genel açıklamalar yaptıktan sonra bu ilişkinin Sosyal Güvenlik Hukuku ba-kımından sonuçlarını ele almaya çalışacağız.
Establishing temporary employment relation-ship through private employment agencies for the first time has been regulated to comply with the “Law on the Amendment to the Labor Code nd Turkish Employment Agency Code” dated 05.06.2016 and No. 6715. The Law, which was ad-opted by the Turkish Grand National Assembly, entered into force after being published in the Official Gazette dated 20.05.2016 and numbered 29717. With this Law, detailed regulations on pri-vate employment offices have been added to Article 7 of the Labor Law No. 4857, titled “tem-porary employment relationship”. In addition, “Regulation on Private Employment Agencies” was issued on this issue on 11 October 2016. Considering the current status of Article 7 of the Labor Law, a temporary employment relation-ship can be established through the private em-ployment agency or by assigning it to the hold-ing body or at another workplace affiliated with the same group of companies. The temporary employment relationship established through the private employment agency is also defined as the temporary employment relationship ac-quired as a profession as well. In this study, we will try to deal with the results of this relation-ship in terms of Social Security Law after making general explanations about the temporary em-ployment relationship established through the private employment office.
