dc.description.abstractUzun süreden beri yürürlükte olan disiplin amirleri ve disiplin kurullarına ilişkin yönetmelik yürürlükten kaldırılmış ve yerine Devlet Memurları Disiplin Yönetmeliği yürürlüğe girmiştir. Yeni yönetmelik ile bazı değişiklikler yapıldığı gibi daha önce yönetmelikte düzenlenmeyen bazı hususlar da yeni yönetmelikte yer almıştır. Özellikle disiplin soruşturması sürecine ilişkin bazı hususlar düzenleme konusu yapılmıştır. Soruşturma sürecine ilişkin bazı hususların bir kısmı Danıştay içtihadı ile oluşmuş usul kuralı iken bir kısmı tamamen yenidir. Bu çalışmanın konusunu da yeni yönetmeliğin genel olarak incelenmesi oluşturmaktadır. Bu kapsamda yeni yönetmelik, Danıştay içtihatları ışığında mülga yönetmelik ile karşılaştırılmış ve bazı görüşlere yer verilmiştir.
dc.description.abstractThe regulation on disciplinary authorities and disciplinary boards, that has been in force for an extended time, was repealed and replaced by the Disciplinary Regulation on Civil Servants. Some changes were made with the new regulation, and some issues that weren’t previously regulated within the regulation were included in the new regulation. Some issues, particularly regarding disciplinary proceedings, have been regulated. Whereas some issues related to the disciplinary proceedings are the procedural rule formed by the Council of State's jurisprudence, some of them are completely new. The topic of this study is that the general analysis of the new regulation. In this context, the new regulation has been compared with the abolished regulation in the light of the Council of State's jurisprudence and some opinions have been given.
