Özet
Günümüzde, uluslararası hukuk kurallarına göre merak uyandırabilen birçok olay vardır. Merak uyandırmafenomeni, Ortaçağ’dan beri hukukî statülerini devam ettirmeleri, yâni Ortaçağ döneminin kalıtı olarakzamanı geçmiş kavram ve algıların ürünü olaylar olmalarından kaynaklanmaktadır. Böylelikle, yapılarınınbüyük bölümü uluslararası hukukun modern kurallarına uymamaktadır. Bunlardan biri Malta Düzenidir.Açık olarak devlet olmayan Düzen, bir devlet gibi davranmaktadır. Malta Düzeninin, aktif ve pasif elçilikhakkını kullanması suretiyle bir devletmiş gibi hareket ettiği temel konulardan biri diplomasi hukukudur. Bu açıklamaların ışığında, bu makalenin amacı Malta Düzeni’nin diplomatik ilişkilerini kısaca analiz etmektir.
Today there are several cases which might be acknowledged as curious according to the rules of international law. The curious phenomenon stemms from the fact that these cases are the products of outdated concepts and perceptions, which have maintained their legal status since the medieval times, i.e. relics of the medieval era. Henceforth with, most of their structure do not fit modern rules of international law. This very fact may be the main source of confusion about their legal status in modern international law. The Order of Malta is one of them. Although it is obviously not a state, it acts in most cases as if one. The law of diplomacy is one of the main subjects which the Order of Malta acts as if it is a State, since it exercises the right of legation, both active and passive. In the light of these explanations the aim of this article is to briefly analyze the diplomatic relations of the Order of Malta.
