| dc.description.abstract | Children are subject to different provisions compared to adults due to their incomplete physical and mental development, their dependency, and their need for protection and education. In this regard, it is seen that many provisions are included in our domestic law and some international conventions to which we are a party. Some of these provisions are related to the age of child labour. Article 50/1-f of the Turkish Penal Code stipulates that the short-term imprisonment sentence imposed on a person may be converted into the alternative sanction of "labour for public benefit". The Court of Cassation accepts that the said alternative sanction cannot be applied to children aged 12-15, as the regulation in Article 71 of the Labour Law No. 4857 (It is forbidden to employ children under the age of fifteen) prevents this. In this study, the issue of whether the provisions regarding the age of labour of the child in our domestic law and in some international conventions to which we are a party constitute an obstacle to the conversion of the shortterm imprisonment sentence imposed on the child dragged into crime to the alternative sanction of "labour for public benefit" is addressed. | |
| dc.description.abstract | Çocuklar; henüz fiziksel ve ruhsal gelişimlerini tamamlamamış olmaları, bağımlılıkları, korunmaya ve eğitime olan ihtiyaçları nedeniyle yetişkinlere nazaran farklı hükümlere tabi tutulmaktadır. Bu hususta, iç hukukumuzda ve tarafı olduğumuz bazı uluslararası sözleşmelerde birçok hükme yer verildiği görülmektedir. Bu düzenlemelerden bazıları da çocuğun çalıştırılma yaşına ilişkindir. Türk Ceza Kanunu m. 50/1-f’de yer alan düzenlemede, kişi hakkında verilen kısa süreli hapis cezasının “kamuya yararlı bir işte çalıştırılma” seçenek yaptırımına çevrilebileceği öngörülmüştür. Yargıtay, söz konusu seçenek yaptırımın 12-15 yaş grubundaki çocuklar hakkında uygulanamayacağını, zira 4857 sayılı İş Kanunu m. 71’deki düzenlemenin (On beş yaşını doldurmamış̧ çocukların çalıştırılması yasaktır) buna engel olduğunu kabul etmektedir. Bu çalışmada, iç hukukumuzda ve tarafı olduğumuz bazı uluslararası sözleşmelerde çocuğun çalıştırılma yaşına ilişkin hükümlerin, suça sürüklenen 12-15 yaş grubundaki çocuklar hakkında verilen kısa süreli hapis cezasının “kamuya yararlı çalıştırılma” seçenek yaptırımına çevrilmesine engel teşkil edip etmediği hususu ele alınmaktadır. | |
