| dc.description.abstract | Yükseköğretim kurumlarının etkin ve adil bir şekilde işleyişi, atama işlemlerinin mevzuata ve hukuka uygunluğuna bağlı olarak büyük bir önem teşkil etmektedir. Ancak, bu atama işlemlerine yönelik hukuki itirazlar ve uyuşmazlıklar, sistemin işleyişini etkileyebilmektedir. Bu nedenle yükseköğretim akademik personelinin atama süreçlerinin hukuki yönlerini, ilgili yasal düzenlemeleri; atama işlemlerinin nasıl gerçekleştiğini ve kadro atama işlemlerine dair idari işlemlerin iptal edilmesine ilişkin yargı süreçlerinin analizi gerekmektedir. Bu çalışmada, yükseköğretim akademik personelinin atama işlemlerine karşı açılan iptal davaları ve yargılama sürecinde mahkemeler tarafından tartışılan önemli konular tespit edilerek ayrıntılı bir şekilde incelenmiştir. Çalışma, yükseköğretim akademik personelinin atama işlemleri ve bu işlemlere karşı açılan iptal davaları konularına hukuki bir perspektif sunmayı hedeflemektedir. Ayrıca yükseköğretim akademik personeli atama işlemlerine karşı açılan iptal davalarında davacı ve idare arasındaki süreçleri daha iyi anlamak, hukuki sonuçları tahlil etmek isteyenler için emsal karar incelemeleriyle zenginleştirilmiş bir kaynak niteliği taşımayı amaçlamaktadır. | |
| dc.description.abstract | The effective and fair functioning of higher education institutions is of great importance depending on the compliance of appointment procedures with the legislation and the law. However, legal objections and disputes regarding these appointment procedures may affect the functioning of the system. For this reason, it is necessary to analyse the legal aspects of the appointment processes of higher education academic staff, the relevant legal regulations, how the appointment processes are carried out, and the judicial processes regarding the cancellation of administrative actions regarding staff appointment processes. In this study, the actions for annulment filed against the appointment procedures of higher education academic staff and the important issues discussed by the courts in the judicial process are identified and examined in detail. The study aims to provide a legal perspective on the appointment procedures of higher education academic staff and the actions for annulment filed against these procedures. In addition, it aims to be a resource enriched with precedent decisions for those who want to better understand the processes between the plaintiff and the administration and to analyse the legal results in the actions for annulment filed against the appointment procedures of higher education academic staff. | |
