Özet
Bir taraftan yaşam hakkı ve sağlık hakkı gibi temel hak ve hürriyetlerden beslenen, diğer taraftan ahde vefa ilkesi gereği ödenen bedellerin karşılığının tam ve eksiksiz ifası gerekliliğini havi sağlık hizmet sözleşmeleri etrafında şekillenen sağlık hukuku, geçmişte olduğu gibi bugün de gerek teorik alanda gerekse hukuk uygulamaları alanında önemini artarak sürdürmektedir. Sağlık hizmetlerinin özelleştirilmesi, kamu sağlık politikalarındaki liberal dönüşümler sektördeki serbestiyi beslemekte, bu sayede özel sağlık hizmeti sunucuları olarak özel sağlık kurumlarının yaygınlaşmasını teşvik etmektedir. Özel sağlık kurumları ile sağlık hizmetinden faydalanan kişilerin kurduğu bağ, sağlık hukukunun temel unsurlarından biri haline gelmiştir. Sağlık hizmetlerinin liberal politikalar vasıtasıyla özel sağlık kurumları ile kurduğu bağ, sağlık hukukunun özel hukukla olan ilişkisini de geliştirmektedir. Bu kapsamda olmak üzere yaygınlaşan özel sağlık kurumlarının kendine has hukuki statüsü de dikkate alınarak hasta ve hastane arasındaki hak ve sorumluluklara mercek tutan çalışmalar sık karşılaşılan hukuki sorunların çözümünde faydalı bir birikim oluşturmaktadır. Biz de çalışmamız da bilhassa tıbbi uygulamaların ortaya çıkardığı hukuki sorunlarda sorumluluğun tayini ve zarar ziyan tazminine yönelik talep ve davalara uygulanacak hukuk ile ilgili olarak hukuki enstrümanların kaynakları, usuli süreçler ve uygulamadaki sorunlar üzerinde durduk. Özetle özel sağlık kurumlarının hukuki statüsü ve bu hastanelerin tıbbi uygulamalarından kaynaklı zararların giderilmesi yönteminin mevzuat ve hukuktaki karşılığını tezimize konu edindik.
Health law, which is nourished by fundamental rights and freedoms such as the right to life and the right to health, on the one hand, and on the other hand, health law, which is shaped around health service contracts that require full and complete performance of the prices paid in accordance with the principle of covenant loyalty, continues to increase its importance both in the theoretical field and in the field of legal practice today, as in the past. Privatization of health services and liberal transformations in public health policies feed the liberalization in the sector, thus encouraging the proliferation of private health institutions as private health service providers. The link between private health institutions and the beneficiaries of health services has become one of the fundamental elements of health law. The bond that health services establish with private health institutions through liberal policies also develops the relationship between health law and private law. In this context, studies that focus on the rights and responsibilities between the patient and the hospital, taking into account the unique legal status of private health institutions that have become widespread, constitute a useful accumulation in solving common legal problems. In our study, we have focused on the sources of legal instruments, procedural processes and problems in practice, especially regarding the determination of liability in legal problems arising from medical practices and the law to be applied to claims and lawsuits for compensation for damages. In summary, the legal status of private health institutions and the method of compensation for damages arising from the medical practices of these hospitals in legislation and law have been the subject of our thesis.
