| dc.description.abstract | Tarih boyunca insanı anlama çabasının en önemli hareket noktalarından biri onun toplumsal bir canlı olduğu düşüncesidir. Bu nedenle toplumsallık insanın kimlik inşasının temel yapı taşlarından biridir. İnsanın toplumsallığı bir düzen ihtiyacını beraberinde getirmektedir. Zira bir düzen mekanizması geliştirmemiş hiçbir toplum düşünülemez. Söz konusu düzen mekanizmaları nitelik itibariyle farklılık gösterse de bunların en etkili olanı şüphesiz hukuktur. Çünkü hukuk düzensizliğe karşı en yoğun ve en ağır yaptırımları içeren bir sistemdir. Hukuk ile toplum arasındaki bu karşılıklı ve sıkı ilişki 19. yüzyılın ikinci yarısından itibaren sosyolojinin bir alt disiplini olarak hukuk sosyolojisini ortaya çıkmasıyla daha da yoğunlaşmıştır. Artık hukuk sosyolojisi hukukun bilimselliğinin kanıtı olarak kabul edilmeye başlanmıştır. Aynı şekilde hukuk sosyolojisi 20. yüzyılda toplumsal hareketleri anlayabilmek adına başvurulan öncelikli alanlardan biri haline gelmiştir. Çünkü hukuk modern toplumun inşasında belirleyici bir faktördür. Bu denli önemli olan hukuk sosyolojisi, Türk sosyoloji düşüncesi içinde de doğrudan ya da dolaylı olarak etkin bir konuma sahip olmuştur. Osmanlı Devleti'nin son dönemlerinde Batılılaşma etkisi, Fransa'daki sosyoloji çalışmalarını takip ve tercüme eden aydınların hukuk ile sosyoloji arasındaki ilişkiye dair çalışmaları Türkiye'de hukuk sosyolojisine duyulan ilgilinin artmasına neden olmuştur. Özellikle 1933 Üniversite Reformu ile hukuk sosyolojisinin üniversitelerde müstakil bir ders olarak okutulmaya başlanması ile hukuk sosyolojisi ilgisi kurumsallaşmaya başlamıştır. Bu dönemle birlikte Türkiye'de hukuk sosyolojisinin gelişimi hız kazanmış ve günümüze kadar toplumsal, siyasal, hukuksal, ekonomik, kültürel hareketlilikler hukuk sosyolojisinin bu gelişimini şekillendirmiştir. Bu çalışmada Türk sosyoloji düşüncesi içinde bir alt disiplin olarak hukuk sosyolojisinin gelişimi tarihsel bir bütünlük içinde ele alınacaktır. | en_US |
| dc.description.abstract | One of the most important starting points of the effort to understand man throughout history is the idea that he is a social creature. For this reason, sociality is one of the basic building blocks of human identity construction. The sociality of man brings with it the need for an order. Because it is unthinkable to think of any society that has not developed an order mechanism. Although the said order mechanisms differ in nature, the most effective one is undoubtedly the law. Because law is a system that includes the most intense and heaviest sanctions against irregularity. This mutual and close relationship between law and society has intensified with the emergence of sociology of law as a sub-discipline of sociology since the second half of the 19th century. Now the sociology of law has begun to be accepted as the proof of the scientificness of law. Likewise, the sociology of law has become one of the priority fields applied in order to understand social movements in the 20th century. Because law is a determining factor in the construction of modern society. The sociology of law, which is so important, has had an effective position in Turkish sociological thought either directly or indirectly. The effect of Westernization in the last period of the Ottoman Empire, the studies of the intellectuals who followed and translated the sociology studies in France on the relationship between law and sociology, caused an increase in the interest in the sociology of law in Turkey. Especially with the 1933 University Reform, the sociology of law started to be taught as an independent course in universities, and the interest in sociology of law started to become institutionalized. With this period, the development of sociology of law in Turkey gained speed and social, political, legal, economic and cultural movements have shaped this development of sociology of law until today. In this study, the development of sociology of law as a sub-discipline in Turkish sociological thought will be discussed in a historical integrity. | en_US |
