| dc.description.abstract | 2020 yılının Mart ayında ülkemizde ilk vakası görülen, Dünya Sağlık Örgütü'nce(WHO) pandemi olarak ilan edilen Koronavirüs(COVİD-19) hastalığı ülkemizde o dönem hayatın akışını tamamen alt üst etmiştir. Güncel ceza kanunumuz olan 5237 sayılı Türk Ceza Kanunu'nda düzenlenen 195.madde ise o dönem birçok hukukçu tarafından televizyon programları, online ve baskı yayınlarda tartışma konusu olmuş, üstüne çeşitli çalışmalar yapılmıştır. Biz, çalışmamızın konusu olan bulaşıcı hastalıklara ilişkin tedbirlere aykırı davranma suçunun kanun maddesinde ne kadar anlaşılabilir düzenlendiğini, kanunilik ilkesine aykırı olup olmadığını, idarenin düzenleyici tedbirleriyle ilgili suç tipinin insanlara bir suç olarak atfedilip atfedilemeyeceğini ve ilgili suç tipini ceza hukukunun hemen hemen her boyutuyla incelemeye özen gösterdik. Salgın hastalıklara karşı ülkemizde alınan tedbirlere ve ülkemizde bu hastalıklarla baş etme yöntemlerinin tarihçesine de çalışmamızda yer verdik. Salgın hastalıklara karşı günümüzde olan yaptırımları incelerken geçmişe de bakmamız gerektiği kanaatindeyiz. Ayrıca ülkemizde 2020 yılından sonra gündeme gelen ve insanların bu konuyla ilgili sürekli olarak yaptırıma tabi tutulduğu bir konuda ilgili suç tipinin her açıdan incelenmesi gerektiği düşüncesindeyiz. | dc.description.abstract | Coronavirus (COVID-19) disease, the first case of which was seen in our country in March 2020 and declared as a pandemic by the World Health Organization(WHO), completely disrupted the flow of life in our country at that time. The artical 195, which is regulated in the Turkish Criminal Code No. 5237, which is our current criminal code.the article, on the other hand, was the subject of discussion by many lawyers at that time in television programs, online and print publications, and various studies were conducted on it. We have taken care to examine how understandable the Crime of Violating the Measures Related to Infectious Diseases, which are the subject of our study, is regulated in the article of the law,whether it is contrary to the principle of legality,whether the type of crime related to the regulatory measures of the administration can be attributed to people as a crime, and the type of related crime in almost every dimension of criminal law. We also included in our study the measures taken in our country against epidemic diseases and the history of methods of coping with these diseases in our country. We believe that when examining the current sanctions against epidemic diseases, we should also look at the past. In addition, we think that the type of crime related to an issue that is on the agenda after 2020 in our country and people are constantly subject to sanctions related to this issue should be examined from all angles.
