Özet
Sağlık kavramını açıklamaya yönelik çabaların bir sonucu olarak sağlık kavramı, çeşitli dönemlerde farklı kavramlar birlikte değerlendirilmiştir. Sağlığa bakış açısının değişmesi de ulusal ve uluslararası belgelerde tanımların değişmesine sebebiyet vermiştir. Sağlık kavramı, başlarda hastalıklı olmamak olarak değerlendirilirken, sonraki dönemlerde fiziksel, ruhsal ve sosyal açıdan iyi olma hali olarak değerlendirilmiştir. Bu çalışmada öncelikle konumuzun ana yapısı olan sağlık kavramından ne anlaşılması gerektiği üzerinde durulmuştur. Sağlık kavramının farklı dönemlerde ve farklı belgelerde nasıl açıklandığı belirtilmiştir. Kişiler hayatlarını sağlıklı bir şekilde devam ettirmeyi istemektedirler. Devlet de kişilere sağlıklı bir ortam sağlamakla yükümlüdür. İşte bu noktada kişilerin sağlıklı olmayı talep etmesi yani sağlık hakkı ortaya çıkmıştır. Sağlık hakkı, haklar arasında büyük öneme sahiptir. Sağlık hakkı, diğer hakları da ilgilendirmesi sebebiyle insan haklarının temelinde yer alır. Sağlık hizmeti de, devletin pozitif yükümlülüğü kapsamında kişilerin sağlıklı olması için sunulan hizmettir. Sağlık hizmeti; sağlık hakkına saygı gösterilmesi, saygı hakkının korunması ve saygı hakkının gereklerinin yerine getirilmesini amaçlamaktadır. Sağlık hizmeti; beslenme, giyim, temiz çevre, barınma, özgürlük, özel hayat, gizlilik, tıbbi hizmet, tutuklu ve hükümlerin sağlığı, zorunlu tedavi, toplum sağlığı ve sosyal güvenlik gibi unsurları da içeren geniş bir kavramdır. Kavram açıklaması sonrasında araştırmalarımız sonucunda emsal teşkil eden Avrupa İnsan Hakları Mahkemesi kararları üzerinde durulmuştur. Özellikle sağlık hakkının Avrupa İnsan Hakları Sözleşmesi'nde ayrı bir hak olarak düzenlenmemesi sebebiyle, sağlık hizmetinin kusurlu işletilmesi sonucunda hangi haklar kapsamında ihlal kararı verildiği tespit edilmiştir. Çalışmamızın ana konusu olan Avrupa İnsan Hakları Mahkemesi tarafından hangi durumlarda sağlık hizmetinin kusurlu işletildiğinin örnekleri ortaya konulmuştur. Kararlar incelenirken de sağlık hizmetinin geniş tanımı dikkate alınmıştır. Avrupa İnsan Hakları Mahkemesi kararlarında, Avrupa İnsan Hakları Sözleşmesi'nde yer alan yaşam hakkı, işkence ve kötü muamele yasağı, özgürlük ve güvenlik hakkı, özel ve aile hayatına saygı hakkı ve ayrımcılık yasağı, sağlık hizmetinin kusurlu işletilmesi ile ilişkilendirilmiştir
As a result of efforts to explain the concept of health, the concept of health has been evaluated together with different concepts in various periods. Changes in the perspective on health have also led to changes in definitions in national and international documents. While the concept of health was initially evaluated as not being diseased, in later periods it was evaluated as a state of physical, mental and social well-being. In this study, we primarily focus on what should be understood from the concept of health, which is the main structure of our subject. How the concept of health was explained in different periods and in different documents is explained. People want to continue their lives in a healthy way. The state is also responsible for providing healthy environment to people. At this point, people's demand to be healthy, that is, the right to health has emerged. The right to health is of great importance among rights. The right to health is at the basis of human rights as it does concern other rights. Health care is a service provided to ensure that people are healthy within the scope of the state's positive obligation. Health care aims to respect the right to health, protect the right to respect and fulfill the requirements of the right to respect. Health care is a broad concept that includes elements such as nutrition, clothing, clean environment, housing, freedom, private life, confidentiality, medical services, health of detainees and prisoners, compulsory treatment, public health and social security. After the explanation of the concept, the decisions of the European Court of Human Rights, which constitute a precedent as a result of our research, were emphasised. In particular, since the right to health is not regulated as a separate right in the European Convention on Human Rights, it has been determined within the scope of which rights a violation decision has been made as a result of the defective operation of the health service. Examples of the cases in which the European Court of Human Rights, which is the main subject of our study, has given examples of the defective operation of the health service. While analysing the decisions, the broad definition of health service was taken into consideration. In the judgements of the European Court of Human Rights, the right to life, the prohibition of torture and ill-treatment, the right to liberty and security, the right to respect for private and family life and the prohibition of discrimination in the European Convention on Human Rights are associated with health services.
